Beyond common sense rules, respecting the safety of property and people, as well as privacy which prohibits flying over any public place, individuals, or animals, it is necessary to ensure that you have all the relevant authorizations, diplomas, insurance, or approvals for using your equipment in compliance with the law. You can also directly consult the text of the Order of December 17, 2015, regarding the use of airspace by unmanned aircraft. Regarding Lithium batteries: Lithium batteries must be used under specific conditions and according to the manufacturer's recommendations. It is necessary to use a specific charger/balancer for Lithium batteries (Li-Polymer or Li-Ion). It is imperative never to charge a battery above 4.20V per cell (8.40V for a 2S, 12.60V for a 3S, 16.80V for a 4S, etc...). Similarly, you should never excessively discharge a battery, i.e., below 3.40V per cell, at the risk of permanently damaging it, or worse, causing a fire. Therefore, it is crucial, if you use a device not equipped with a charge detection system, to monitor the discharge level of your battery. Finally, to hope for maximum battery lifespan, it is recommended to let them rest and cool for about two hours after discharge before recharging them again. Lastly, it is highly recommended to store your batteries individually and in protective bags designed for this purpose (available on the Site). The Client is urged to strictly follow these usage instructions. Indeed, batteries being wear elements, consumable items, their lifespan is directly linked to their usage conditions. The Client is encouraged to read carefully and strictly adhere to the instructions provided with the products sold on the Site (some instructions are provided digitally, via an email inviting you to download said instructions, this email being triggered upon shipment of the goods). In the absence of instructions upon delivery, La Caméra Embarquée commits to providing them to the Client upon a simple written request. In any case, the use of the products will be under the sole responsibility of the Client. Under these conditions, the Client is required to maintain the product in good condition, use it according to its intended purpose, and comply with applicable provisions, prescriptions given by La Caméra Embarquée, and the manufacturer. In this regard, it is discouraged for the Client to make modifications to the product, install accessories, auxiliary parts, or any other non-compliant devices on the product. Besides the induced risks, such modifications would deprive the Client of any warranty. The Client is obligated to use the products in compliance with the current regulations and to fulfill all their legal obligations. La Caméra Embarquée cannot be held responsible for defects and deterioration of the delivered products resulting from abnormal or non-compliant use after the delivery of these products.

Article 9: Price

Products are invoiced according to the current rates mentioned on the Website on the day of the sale. Prices are indicated in euros and include all taxes, with the applicable VAT being that in force at the time of invoicing. They do not include delivery costs, which are billed in addition and indicated before order validation. Full payment of the price must be made at the time of the order. At no time may the sums paid be considered as deposits or down payments. The prices displayed on the website are valid only for products purchased online on this same site. Article 10: Payment Method

To pay for their order, the consumer has the option to choose from all the payment methods mentioned on the order form. Article 11: Product Availability

In the case of available products, the order will be executed no later than in A maximum period of 5 days from the day following the day the consumer paid for their order. Article 12: Delivery Terms

Delivery times: The package is shipped after receipt and validation of your payment. Delivery is then carried out in 2 to 5 days in mainland France (for items in stock). Shipping fees: The shipping fees appear on your order summary; they are calculated based on the total amount of your order, including protective packaging. We cover part of the delivery cost. Delivery issues due to the carrier: Any anomaly regarding the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the delivery note in the form of "handwritten reservations," accompanied by your client signature. As with any shipment, there may be a delivery delay or the product may be lost. If there is a delay in delivery compared to the date indicated in the shipping email, we ask you to report this delay by calling us or sending us an email. We will then contact the carrier to initiate an investigation. An investigation for a delivery in France can take up to 21 days From the start date of the investigation. Article 13: Product Warranty

The consumer is expressly informed that Lacameraembarquee.fr is not the producer of the products presented on the website, within the meaning of Law No. 98-389 of May 19, 1998 And related to the liability for defective products. Consequently, in the event of damage caused to a person or property by a defect in the product, only the producer's liability can be sought by the consumer, based on the information provided on the packaging of the said product. When you act on the legal guarantee of conformity: - You have a period of 2 years from the delivery of the goods to take action. - When the sales contract for the goods provides for the continuous provision of digital content or a digital service for a period exceeding two years, the legal guarantee is applicable to this digital content or digital service throughout the planned provision period. - You are exempt from proving the existence of the lack of conformity of the goods during the 24 months following the delivery of the goods, this period being 12 months in the case of second-hand goods. - You can choose between repairing or replacing the goods, subject to the cost conditions reviewed by article L. 217-12 of the Consumer Code. Subject to the possible exercise of the right of withdrawal, any return of a product must be expressly agreed upon by La Caméra Embarquée and will result, as appropriate, in the repair, replacement of products, issuance of a credit note, or a refund to the Client, after qualitative and quantitative verification of the returned products. The products must be returned with all accessories and instructions that may have been provided. The costs and risks of the return remain the responsibility of the Client. If the product is not received by La Caméra Embarquée, no repair, replacement, credit, or refund can be granted, as La Caméra Embarquée is unable to verify any potential anomalies. Special case of drones: As the causes of a drone crash can be numerous and subject to interpretation, La Caméra Embarquée may, if necessary, request the prior agreement of the manufacturer to assess its proper coverage. In the case of a warranty claim for a drone, La Caméra Embarquée will offer the Client a replacement of the defective parts but does not guarantee the sensors, cameras, accessories, gimbals, landing gear, or any other accessory that may have been damaged in the crash but is not a direct part of the product. In any event, the product must be returned to La Caméra Embarquée with its prior agreement. Special case of camera accessories: As with drones, if the responsibility of La Caméra Embarquée were to be upheld for a camera mount or accessory (e.g., camera mount), it applies strictly to the product in question and does not extend to the attached camera. Special case on FPV electronics: any soldering or modification of the product voids the warranty.

Article 14: Right of Withdrawal

The items must be returned no later than 14 days following the communication of the retraction, at your expense, in their original condition, in order for you to benefit from the right of withdrawal. Simply returning the item without a declaration, or refusing to accept the delivery, is not sufficient to express your intent to withdraw. Only products that are returned in their entirety, in their complete and intact original condition, and in perfect resale condition will be accepted allowing resale in like-new condition. In accordance with Article L.221-23 of the Consumer Code, the consumer declares understanding that any handling other than those necessary to establish the nature, characteristics, and proper functioning of the product results in a depreciation of the item which engages their responsibility. Any product that has been damaged or whose original condition has deteriorated will neither be refunded nor exchanged and will be reshipped to the customer at their expense. This right of withdrawal is exercised without penalty, except for return costs. The risks and costs of returning the products are the responsibility of the Customer. Return merchandise:For mainland France and Belgium: If you do not collect your parcel or refuse its delivery, the return of the parcel is charged to our company. In case of order cancellation and for purchases with free shipping, we will deduct the same amount of €11.90 from your refund. For those who paid the shipping fee, we will deduct the amount of €9.90. These conditions also apply in case of return to sender due to an addressing error when entering the order. 360° solutions, modified products, activated products, hygiene-sensitive products: We do not take back modified products, type GoPro Backbone Ribcage, Inspire 360, Kit GoPro Entaniya, nor activation-type products DJI CARE, Magix software, Kolor, etc., as well as drone certification documents DJI. Due to hygiene measures, mouth fixings with unsealed packaging cannot be returned. Products that require activation for their operation are also excluded from the legal withdrawal period, as their activation initiates the warranty period, preventing the product from being resold as a new item.

Article 15: Zen Option

As part of the Zen Option, you benefit from free return shipping and an extended withdrawal period. If the item(s) do not suit you, you have a period of 30 working days to request a return (compared to the usual 14 working days).

The Zen Option applies only to orders delivered in mainland France.

Only one free return voucher is granted per order. Article 16: Usage Rights

Both parties will then come together within a month, unless prevented by the force majeure event, to examine the impact of the event and agree on the conditions under which the contract will be continued. If the force majeure event lasts longer than three months, the present general conditions may be terminated by the aggrieved party. Article 18: Liability

The responsibility of La Caméra Embarquée cannot be held liable in any case for non-performance or improper performance of contractual obligations attributable to the Client, particularly during the entry of their order. In any case, La Caméra Embarquée disclaims all liability, especially due to:

- From the selection of products by the Client ;

- From the normal wear and tear of its products ;

- Deteriorations or accidents resulting from negligence, lack of supervision or maintenance, or improper use ;

- Damage resulting from modifications, incorporations, or repairs to the product ;

- Malicious acts by the Clients or third parties.

When the responsibility of La Caméra Embarquée is engaged due to its fault, the compensation only applies to the direct, personal, and certain damages that the Client has suffered.

The Dash Cam shall not be held responsible for any temporary or permanent damage caused to the Client's computer system, nor for any potential losses or damages incurred, particularly as a result of accessing or browsing the Site.

The transmission of data via the Internet may lead to errors and/or the Site not always being available. Therefore, La Caméra Embarquée cannot be held responsible for the availability and interruption of the online service.

Article 19: Applicable Law

The present terms and conditions are subject to French law. This applies to both substantive and procedural rules. In the event of a dispute or claim, the consumer will first contact Lacameraembarquee.fr To obtain an amicable solution. In a second step, and in case of appeal, the consumer may file a complaint with the competent courts.

Article 20: Information Technology and Freedoms
